TERMS & CONDITIONS
These terms and conditions tell you general information and the legal terms and conditions on which Rampworx Skatepark provides services to you. It is important that you read and understand the terms and conditions that will apply before you enter Rampworx Skatepark. It is also a condition of using the facility, membership and use of the Skatepark may be withdrawn.
We operate the website www.rampworx.com. We are a registered non-profit organisation, a charity registered under number 1097748 and our registered office at 1-3 Leckwith Road, Aintree, Liverpool, L306UE.
1.OUR CONTRACT WITH YOU
1.1 Rampworx provides access to a number of activities, which include but are not limited to stunt scootering, bmxing, skateboarding, inline skating, youth programmes, holiday clubs, group coaching, one to one tuition, outreach visits, equipment hire, café access, and any other amusement, as well as participating in ASD and other special needs sessions and parties (“Activities”).
1.2 These are the terms and conditions which apply when you book to take part in an Activity with Rampworx Skatepark.
1.3 Please ensure that you read these terms and conditions carefully, and check that the details of your membership/registration and booking information are complete and accurate, before you submit. If you think that you have made a mistake after you have submitted, please contact Rampworx Skatepark to discuss.
1.4 By submitting your booking, you agree that the supply of the activities by Rampworx Skatepark and your participation in the activities is subject to these terms and conditions.
1.5 No booking shall be deemed to have been accepted by Rampworx unless and until a booking reference number has been allocated.
1.6 These terms and conditions also incorporate the terms of the Rampworx Participant Agreement/Risk Acknowledgement and Injury Waiver and Privacy Policy.
1.7 Rampworx reserves the right to revise these terms and conditions from time to time in order to comply with changes in any relevant laws or regulatory requirements.
2.SAFETY
2.1 Participation in the Activities is not without risk as serious misuse could be fatal. You acknowledge that the Activities can be dangerous with many inherent risks and hazards. As a consequence, personal injury, and sometimes fatality, can occur.
In their structural state ramps pose no risk to a user’s health & safety. However misuse, abuse or inability to use the apparatus may result in injury or loss and should only be used for its intended purpose. All participants are required to register for a membership/waiver before participating in any activity.
2.2 As part of our compulsory membership/registration, all participants must watch our safety etiquette video on our website’s membership page prior to submitting.
2.3 During a session, participants will not be individually supervised by a staff member.
2.4 Our minimum age for skatepark use is strictly 5 years old. Children under the age of 10 and people with special needs cannot participate in the Activities unless they are accompanied by a parent, guardian, responsible adult or appropriate carer. The parent, guardian, responsible adult or carer must remain on site for anyone under 10 years of age or anyone with special needs. One adult is permitted to supervise a maximum of ten under 10-year-olds. Rampworx staff are not responsible for children, regardless of the child’s age, or anyone with special needs at any time. For participants under the age of 16, or participants who lack capacity, a parent, guardian, responsible adult or carer is required to complete and sign the membership form on behalf of the participant, stating that he or she will accept responsibility for the safety of himself or herself and for supervision of any children or anyone with special needs in his or her care.
2.5 The Activities are physically demanding and require a degree of strength, agility and stamina. All participants must be reasonably fit, in good health and free from any adverse medical conditions. All participants are subject to the age restrictions for the Activity stated at time of booking. Rampworx recommends that if you have health-related concerns you should consult your health services provider and receive medical clearance before participating in an activity at Rampworx.
2.6 Your equipment must be in full working order and fit for purpose following manufacturing guidelines. Equipment brought may be inspected by staff members upon entry to the Skatepark.
2.7 Whilst using the Skatepark it is strongly recommended that all participants wear full protective equipment at all times including: helmet, knee and elbow pads, closed-toed footwear, wrist-guards (where appropriate) or glove protection. All users under the age of 16 MUST wear a helmet at all times whilst taking part in activities.
2.8 In their structural state ramps pose no risk to a user’s health & safety. However misuse, abuse or inability to use the apparatus may result in injury or loss and should only be used for its intended purpose.
2.9 In the event of an accident participants will report to inform a member of staff immediately.
2.10 In the event of illness, accident or injury, first aid trained staff members will administer first aid.
2.11 Admission restrictions and contra-indications to safe skatepark use:
Forces and actions that could aggravate physical conditions. Excessive participant weight > 125kg/19 stone (which could increase forces on the participant’s body, would/could lead to an increased risk of bone and joint damage and would be an indicator of general lack of fitness and appropriateness of the Activity for the participant).
Circulatory conditions, Heart or lung conditions, Recent surgery, Back or neck conditions (including Rodded back and Brittle bones), High blood pressure Spine, musculoskeletal or head injury, Down’s Syndrome, Disproportionate dwarfism, Pregnancy.
If in any doubt as to your ability to participate safely in the Activities, please seek advice from your GP.
Customers with Down’s Syndrome or disproportionate dwarfism prior to taking part in such activities are required to provide evidence from a GP or Paediatrician that they are fit to take part in the activities.
Customers with Epilepsy – Customers with uncontrolled epilepsy will be asked to obtain their GP’s approval for skatepark activities and other forms of participation taking into account the following:
The type and severity and frequency of seizures The presence or absence of warning signs Known trigger factors (e.g. cold parks, stress, excitement, noise or dazzling lights).
Using the skatepark should only take place when:
Accompanied by a person aged 18 years or over, who must have knowledge of the condition and be able to recognize an attack.
Participation should NOT take place if:
A person with uncontrolled epilepsy feels unwell During peak conditions.
2.7 Participants are advised to scoot/skate/ride within their ability. If you are unsure as to whether you can complete a manoeuvre, you should not attempt it. If participants have medical concerns, they are advised to consult their doctor before attending. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. For clarity, if you are pregnant, have a heart condition, or are wearing any form of plaster cast, you are not allowed to participate in any of the activities. Participants at Rampworx are personally responsible for their own personal well-being.
2.8 Participants need to be able to see similar distances to those required to drive a car in order to be able to participate in an activity and/or to supervise any under 16’s in their care. Consequently, short or long sighted participants must ensure that they wear contact lenses or prescribed glasses.
2.9 Anyone who does not meet the above requirements will not be allowed to undertake the activities involved at Rampworx. It is your responsibility to ensure that all members of your booking meet these requirements.
2.10 Rampworx reserves the right to refuse admittance to participants or to remove a participant from the premises should it be deemed necessary to do so. This includes a participant who does not comply with the safety rules and advice or adherence to the skatepark, a participant whose behaviour is considered unsafe or who is thought to be under the influence of alcohol or drugs. All participants are required to act responsibly and courteously at all times and to respect other participants and Rampworx personnel. Rampworx shall be entitled to prevent any person from undertaking or completing the activities in the event it deems the behaviour of any participant unsuitable. The decision of the Manager on Duty will be final.
2.11 Participants must be dressed appropriately (please see the FAQ’s section of our website) and Rampworx reserves the right to refuse admittance to the activities to any participant who is not appropriately dressed.
2.12 No refunds or compensation will be payable by Rampworx in the event that any participant is not permitted to, or decides not to, undertake or complete the activities for any reason.
3.PRICE AND PAYMENT
3.1 Subject to any terms agreed in writing between Rampworx and you, our charges for all activities and all ancillary products (such as rental equipment) shall be calculated at our current rates from time to time.
3.2 All charges include VAT.
3.3 Payment shall be made in full at the time of booking and can be made by using cash (reception) a debit card or credit card. All payments are made directly to Rampworx.
3.4 Rampworx reserves the right to change its prices at any given time. Though any change in price will not affect any activities which have already been booked and paid for in full at the time that the change in price becomes effective.
4 CANCELLATIONS, TRANSFERS AND REFUNDS – For all bookings including Parties and Group bookings.
4.1 You shall be entitled to cancel your booking at any time. You will have a 24-hour window from the point of payment, be that full or partial payment, where you will be entitled to a full refund (*Additional reference 4.2). Any cancellations occurring after this 24-hour period will only be offered to transfer to another date. No refunds will be issued.
4.2 *If you book within 24 hours of the booking date and time, you will not be entitled to a refund and will only be able to move your booking to an alternative date.
4.3 In the case of a birthday party and/or a group booking of 9 or more people, you must give us a minimum of 14 days’ notice, so we can look for an alternative date. If cancelled within 14 days, you will not receive an exchange or alternative date.
4.4 All Birthday Parties and/or Group Bookings must be paid for, in full, 7 days prior to the booking date. All participants are required to complete the membership (see section 1.3).
4.5 The minimum number of guests for a party booking is 10 guests, should any guest be unable to attend on the day a refund will not be issued.
4.6 Rampworx shall be entitled to cancel your booking at any time. In the event that Rampworx decides to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause, but no other compensation shall be payable.
4.7 If an event outside of Rampworx’ control occurs before the commencement of the activity which means that Rampworx is not able to provide the activity booked, then the booking is refundable by means of an offer to transfer to another date and time.
4.8 Payments made by debit or credit card will be refunded to the same card.
4.9 No refunds will be given for transactions made by gift vouchers. Bookings may be transferred in adherence with points 4.1, 4.2 and 4.4 as set out in this document.
4.10 Where multiple forms of payment are used, Rampworx reserves the right to refund any monies due by debit or credit card.
4.11 The Skatepark operates on strict session times and the entry fee is allocated to the appropriate session block. Late arrivals must still pay the full session price. No compensation or partial refunds may be given for lost time.
4.12 Vouchers and promotional discounts or offers are NOT valid during event days and cannot be transferred. Please ensure you check our website/social media for up to date information regarding events.
5 OUR LIABILITY TO YOU
5.1 Rampworx, it’s employees, directors and agents are not liable to you, your dependents or legal representatives for any claim for any indirect or consequential loss or damage, including without limitation personal injury or financial loss or damage, whether such liability arises in breach of contract, tort (including negligence), statute or statutory duty save that nothing is intended to nor shall limit the liability of Rampworx in respect of death or personal injury caused by the negligence of Rampworx or of its employees, agents or contractors or affect the statutory rights of any person dealing as a consumer.
5.2 Rampworx will not be responsible for the loss or damage of or to any of your property or personal belongings during your visit to the venue or arising from the booking of or participation in the activities. Personal possessions are brought into the venue entirely at the owners’ own risk.
5.3 Parking facilities are available at the site and any vehicles and their contents are left at the owners’ risk.
5.4 Except as otherwise stated, any liability of Rampworx shall be limited to the refund of any charges paid to Rampworx.
6.EVENTS OUTSIDE OUR CONTROL
6.1 Rampworx shall not be liable or responsible for any failure to perform, or delay in performance of, any of Rampworx’s obligations under these terms and conditions that is caused by any act or event beyond which is beyond Rampworx’s reasonable control.
6.2 If an event outside of Rampworx’s control takes place that affects the performance of Rampworx’s obligations under these terms and conditions, you will be contacted as soon as reasonably possible and Rampworx’s obligations under these terms and conditions shall be suspended for the duration of the event.
6.3 If an event outside of Rampworx’s control occurs before the commencement of the Activity which means that Rampworx is not able to provide the Activity which has been booked, then the booking is refundable by means of an offer to transfer to another date and time.
6.4 In the event that it proves necessary to close the skatepark or cancel any Activities for reasons beyond the control of Rampworx and in circumstances where your party has commenced participation in the activities, you shall not be entitled to any refund (in part or in whole). In such circumstances Rampworx may, but shall not be obliged to, offer alternative dates or times at reduced rates.

- OTHER IMPORTANT TERMS
8.1 Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
- SKATEPARK RULES & REGULATIONS
9.1 Staff (including volunteers) may request that participants cease using a particular obstacle to enable others to do so.
9.2 Rampworx Skatepark has a zero tolerance policy on abusive behavior of any kind towards fellow users and staff members. Participants may be asked to leave the Skatepark in this event and be refused future admission.
9.3 Alcohol/drug use or possession is forbidden on Skatepark premises AT ANY TIME. Anybody deemed to be under the influence may be refused entry to the facility. Smoking or vaping is not permitted inside the building.
9.4 Food or drink is to be consumed only in the designated areas.
Any spillages must be reported to a member of staff.
9.5 Participants and spectators must use the waste bins provided to dispose of any rubbish. Users must only eat or drink within the designated viewing areas.
9.6 Littering, vandalism or unauthorised graffiti is strictly prohibited.
9.7 Participants will be responsible for the replacement of any rental equipment or safety gear that is damaged due to misuse.
9.8 I give authorised Rampworx staff/media teams photographic/videographic consent as an individual or group participant. This includes external media coverage during skatepark events. I agree that the photo’s/videos may be used for promotional use by the Skatepark.
10 PRIVACY POLICY
It is your responsibility to ensure contact information is kept up to date. If your details change, please notify a member of staff at reception to make the necessary amendments.
10.1 Information Collected
In general, you may visit the site without any personally identifiable information. Our servers collect the domain names, operating system in use (e.g., Macintosh, Windows) and browser (e.g., Netscape, Internet Explorer).This information is aggregated to measure the number of visits, average time spent on the site, pages viewed, etc. Rampworx uses this information to measure the use of our site and to improve the content. E-mail addresses and other personally identifiable information such as first and last name, home address, telephone number, and other similar information, are known only when voluntarily provided by a visitor for registration.
10.2 Use Of Your Information
We may use the personal information you provide for any of the following purposes: (1) to understand the use of our site and make improvements; (2) to fulfill prizes; (3) to respond to specific requests from visitors; (4) to protect the security or integrity of our site when necessary; (5) to send you notices and solicitations regarding site and our businesses; and (6) in general to promote and market products to you.
These solicitations may take the form of mailings, telephone calls, e-mail and other methods of contact. If you do not want to receive these solicitations from us using your personally identifiable information, please notify us.
10.3 Disclosures Of Your Information
Unless otherwise disclosed during the collection, personally identifiable information that may be collected in connection with visitors to this site is retained by Rampworx. Rampworx does not sell, transfer or otherwise disclose this personally identifiable information outside of this company, except where disclosure is required by law.
10.4 Other Websites
This site may contain links to other third party websites. We are not responsible for the content or privacy practices of other sites. We may revise this Privacy Policy from time to time. You are responsible for checking this policy. If you do not agree with the policy, you should cease use of the site immediately.
10.5 Cookies
A technology called “cookies” may be used to provide you with tailored information. A “cookie” is a tiny element of data that a website can send to your browser, which may then be stored on your hard drive so we can recognise you when you return. You may be able to set your browser to notify you when you receive a cookie. Our cookies collect the operating system and browser that a visitor is using.
